About the Practice

Smith Gambrell & Russell’s Intellectual Property lawyers are well-qualified to guide clients through both the domestic and international trademark law systems. We work closely with our clients in determining the availability and registrability of a trademark or service mark, the preparation of the necessary applications and the prosecution of those applications to registration. Internationally, we work with our network of foreign associates to obtain foreign registrations in other countries for our U.S. based clients and we assist our foreign clients in obtaining U.S. registrations. We also assist in the negotiation and consummation of license, assignment and co-existence agreements.

We offer our clients extensive capabilities in the protection and enforcement of trademark rights. This includes policing unauthorized trademark use and litigating issues of trademark infringement and unfair competition in state and federal courts as well as administrative proceedings before the Trademark Trial and Appeal Board. We help develop and institute protection and enforcement strategies that are tailored to our client’s business and the industries in which they compete.

Our Trademark Law Group draws upon a wealth of experience both as private practitioners and as former Examiners with the United States Patent and Trademark Office. We count among our members:

  • a past Chair of the Patent, Trademark and Copyright Section of the District of Columbia Bar;
  • three past Chairs of the Intellectual Property Section of the State Bar of Georgia; and
  • a former Trademark Examining Attorney for the USPTO.

In addition, the attorneys in our Trademark Group are active with intellectual property organizations including International Trademark Association (INTA), Intellectual Property Owner’s Association (IPO), American Intellectual Property Association (AIPLA) and the Licensing Executives Society (LES).
