About Gene

Gene Volchenko advises and represents clients in complex intellectual property and commercial litigation matters, including patent, trademark, trade dress, copyright, trade secret, breach of contract, breach of fiduciary duty, shareholder, and other business disputes. He helps clients assess risk, protect their interests, and make practical decisions throughout litigation. His experience spans federal courts, state courts, and administrative proceedings, including inter partes reviews before the Patent Trial and Appeal Board.

Gene works with clients day to day on the issues that drive disputes, including evaluating claims and defenses, developing case strategy, preparing pleadings and motions, managing discovery, coordinating with technical and damages experts, and preparing matters for hearings, trial, or resolution. He advises clients through each stage of a case, helping them address legal and business challenges as they arise and providing practical guidance tailored to their goals.

His work has involved technologies and industries including medical devices, software, network security, and consumer products, while also extending to broader business and commercial conflicts. With a background in biomedical engineering, Gene is able to quickly understand technical subject matter and translate complicated issues into clear, practical advice clients can use. He has developed infringement, noninfringement, invalidity, and validity positions, led technical investigations, and drafted pleadings and dispositive motions in high-stakes matters, while also handling claims involving business torts, fiduciary obligations, and internal company disputes.

Before joining SGR, Gene practiced at an intellectual property boutique, where he supported clients through all phases of litigation and administrative review. During law school, he served as an editor of the Intellectual Property Journal, worked at the Patent Hub assisting with prior art searches and invention intake, and completed a judicial externship with the Honorable Patricia O’Brien Sheahan of the Circuit Court of Cook County.

Gene also dedicates time to pro bono work, assisting individuals seeking to expunge or seal their criminal records through the Greater Chicago Legal Clinic.

  • Helped achieve an eight-figure settlement in a medical device patent infringement dispute the day before opening statements, using detailed technical analysis, strategic case positioning, and focused litigation management to help drive a favorable resolution.
  • Secured a favorable settlement for the owner of a clothing and footwear brand in a trade dress infringement matter, protecting the client’s brand interests while avoiding prolonged litigation.
  • Negotiated a favorable license agreement on behalf of a patent owner in a dispute with an accused infringer, aligning the resolution with the client’s enforcement and business goals.
  • Advised businesses in commercial litigation and internal business disputes, including breach of contract, breach of fiduciary duty, and shareholder conflicts, with an emphasis on practical strategy and efficient resolution.
