Christopher Tumulty is a trusted advisor and litigator for clients in the real estate and construction industries, providing strategic counsel and representation in a broad range of legal matters. • Represented cooperative apartment board in securing removal and repair of illegal roof structures/alterations, which had caused extensive damage to roof and parapet walls.
• Represented general contractor in securing summary judgment on claims for unpaid construction work in high-end interior building renovations.
• Preserved claims of cooperative apartment board in defeating motion and appeal based on allegations of untimely claims, creating new law and protections for co-op’s enforcing lease provisions beyond initial statute of limitations.
• Obtained court order for cooperative board access to individual units in connection with necessary repair to building façade and windows per City directives.
• Regular successful collection of unpaid maintenance and common charges for co-op and condo boards, including fees and reimbursement of expenses.
• Represented committees of owners in enforcing rights against sponsors for breaches of offering plan and/or failure to turn over board control.
