Sam discussed the EEOC's efforts to scale back guidance on disparate impact liability and to revise regulations under the Pregnant Workers Fairness Act (PWFA). He noted that while the EEOC cannot repeal the underlying statutes, its proposed changes signal a significant shift in enforcement priorities.

"The real target here is disparate impact. The EEOC can't touch that statute, so, instead of repealing it, it looks like they're starving it."
