Roberto M. Suárez

Rob Suárez helps clients capture the commercial value of innovation before competitors can design around it. His perspective is grounded in experience on both sides of the innovation process. Before entering patent practice, Rob spent more than 15 years as a mechanical engineer developing products in the aviation, marine, consumer-electronics, and mobile-device industries. He is also an inventor, giving him a practical understanding of how ideas move from concept through engineering, manufacturing, launch, and commercialization.

Rob advises startups, established companies, individual inventors, and business owners on patents, trademarks, copyrights, trade secrets, licensing, and broader intellectual property strategy. He prepares and prosecutes U.S. and international patent applications, develops and manages patent and trademark portfolios, evaluates patentability and freedom-to-operate issues, and assists with IP due diligence, enforcement, and dispute strategy. His patent work spans mechanical and electromechanical systems, aerospace technologies, consumer products, manufacturing processes, medical devices, software-enabled systems, and chemical and formulation-based products.

Clients rely on Rob to translate effectively among inventors, engineers, executives, and legal teams. He begins with the client’s business objective, then develops an IP strategy aligned with product development, investment, market entry, licensing, and competitive positioning.

Rob is also an adjunct professor at Florida International University College of Law and FIU’s College of Engineering and Computing, where he teaches intellectual property and business law. He is fluent in Spanish and works with U.S. and international clients, including entrepreneurs and companies serving Latin American markets.

• Builds layered patent portfolios that protect products at multiple levels, including overall systems, individual components, control logic, manufacturing methods, and methods of use.
• Prepares and prosecutes utility and design patent applications involving mechanical and electromechanical systems, aircraft structures and systems, mobile devices, consumer electronics, marine and fishing equipment, injection molding, CNC machining, sheet-metal fabrication, and software-enabled processes.
• Guides founders, inventors, and product-development teams from invention capture and provisional filing through nonprovisional and PCT strategy, prosecution, continuation practice, foreign filing, and portfolio maintenance.
• Performs patentability, freedom-to-operate, infringement, validity, and claim-scope analyses to support product launches, licensing discussions, investment decisions, pre-suit disputes, and litigation strategy.
• Develops domestic and international trademark portfolios, responds to substantive USPTO refusals, and represents clients in Trademark Trial and Appeal Board oppositions and coexistence negotiations.
• Drafts and negotiates intellectual property licenses, assignments, confidentiality provisions, development agreements, and ownership provisions for technology and product-development relationships.
• Advises clients on coordinated protection through patents, trademarks, copyrights, and trade secrets, selecting the forms of protection that best support the client’s commercial objectives.
• Advises patent owners on post-issuance patent strategy, including inter partes review, ex parte reexamination, and supplemental examination proceedings.
