Cassie R. Daum

Cassie Daum represents both plaintiffs and defendants in a broad range of civil litigation matters in state and federal courts. Cassie understands that every dispute is different and works closely with clients to develop practical, tailored strategies that align with their goals—whether pursing a claim or defending against one.

With a strategic and results-driven approach, Cassie handles complex disputes from the early stages of investigation and discovery through trial and appeal.  Cassie’s practice encompasses complex commercial litigation, including contract and insurance disputes, shareholder disputes, employment and non-compete disputes, and real property litigation. Cassie works closely with clients to navigate high-stakes disputes efficiently while protecting their long-term interests. Whether advocating in the courtroom or negotiating favorable resolutions, Cassie is committed to optimal outcomes even in the most challenging cases.

Prior to joining Smith Gambrell & Russell, Cassie was an intern at the United States Attorney’s Office for the Middle District of Florida and a summer associate at SGR. While in law school, Cassie was an editor of the Florida Law Review, served as a board member of the John Marshall Bar Association, and was the recipient of several book awards.

Originally from Pensacola, Florida, Cassie is a PADI certified diver and enjoys spending time at the beach. When she’s not in the office, she also enjoys traveling and reading. Cassie has a goal of visiting all 50 states and all 7 continents.

Representative Matters

• Successfully defended client at summary judgment stage on claims alleging tortious interference with business relationship, breach of fiduciary duty, and unjust enrichment, and obtained defense verdict at bench trial on breach of contract claim
• Pursued claims for violations of Section 10b-5 of the 1934 Securities and Exchange Act, the Florida Securities Investor Protection Act, and common law fraud in the inducement on behalf of investors in federal court, resulting in a favorable resolution for the investors
• Successfully defended former employee in defense of breach of restrictive covenant case
• Set aside a default judgment and dissolved writs of garnishment which had resulted in $3 million of the client’s funds being frozen, where client had received no notice of the lawsuit or the trial on damages
• Reached favorable resolution for client in dispute between hospital and physician’s group on claims alleging billing and coding errors
• Successfully represented local restaurant, whose property had been damaged during Hurricane Ian, in pre-suit negotiations with insurer for property damage and business interruption claims
• Navigated claims of breach of a purchase and sale agreement by the seller of a large business complex and helped reach a favorable resolution resulting in a closing on the property
