SGR Secures Summary Judgment for Client in Environmental Clean-up Litigation

SGR’s defense team of Steve O’Day, Chris Bowers, Jessica Lee Reece and Josie Nackers secured summary judgment for its trucking client in a long-running claim against it for clean up costs at a site in Dalton, Georgia.  Barrett Properties, LLC, et al v. CCL Enterprises, Inc., et al, Superior Court of Whitfield County, Georgia (Order, May 13, 2011). Chinese and American Officials Meet to Discuss Clean Energy Cooperation

Last week, top Chinese and American officials – including Chinese President Hu Jintao – met to discuss clean energy cooperation among the two countries. China and the United States are the two largest emitters of greenhouse gases. Chinese representatives also report that, by 2020, China plans to have double the economic output it did in 2000 so that, by 2050, China could be using half the world’s energy. New Years resolutions and I have a pretty tenuous relationship. January rolls around and I make some vow or another but by mid-February I am back to my old ways. Not this year. SGR Attorney to Speak at International Solar Conference

SGR Environmental and Sustainability attorney Jessica Lee Reece will be speaking at the upcoming Solar Praxis “PV Power Plants 2010” conference in Las Vegas, Nevada. Life in the Green Lane: The Sins of Greenwashing.

For those of us who have been diligently trying to “go green” while shopping last week’s news was more than a little disheartening. According to the “Sins of Greenwashing: Home and Family Edition,” released by North American environmental marketing company TerraChoice, more than 95% of consumer products examined committed at least one “greenwashing” violation. Ninety-five percent! Obviously, not a good thing. In conducting its study, TerraChoice examined more than 5,000 products in 34 stores in the U.S. and Canada and found more than 12,000 “green” claims among them. More Challenges to EPA Greenhouse Gas Rulemaking

Beginning last December and continuing through this past May, EPA has issued four main rules regarding regulation of greenhouse gas (GHG) emissions. Since that time, more than 150 businesses, advocacy groups, trade associations and government entities have challenged EPA’s decision-making. With so many litigants involved, and with Senator Kerry announcing a climate bill is unlikely to be passed in the near future, it is becoming more likely that the nation’s climate policy will be shaped in the courtroom.
