Mr. Wasmuth focuses his practice on litigation and has particular expertise in appellate practice. He also represents clients in products liability and antitrust litigation. His courtroom experience includes over 20 jury trials and 100 appeals in many different jurisdictions around the country.
Mr. Wasmuth has represented a firm client in an appeal that resulted in the reversal of the dismissal of a multi-million dollar antitrust claim, and another client in an appeal that resulted in reversal of a multi-million dollar civil rights judgment. He also has successfully pursued an appeal that led to the Missouri Court of Appeals recognizing a report’s privilege limiting discovery in libel cases.
Mr. Wasmuth serves as the General Counsel of Smith, Gambrell & Russell, LLP.
He is a member of the Georgia Bar Association, and the Defense Research Institute (DRI).
A native of Pennsylvania, Mr. Wasmuth received a B.A. with honors in Political Economy from Johns Hopkins University in 1981. In 1984 he received his J.D. from the University of Virginia, where he was Executive Editor of the Virginia Journal of Natural Resources Law. He is a member of the Order of the Coif and winner of the William Minor Lile Moot Court Competition and the Stephen Pierre Traynor Award. While in law school, Mr. Wasmuth served as a part-time law clerk for the Honorable Herbert Pickford, Judge in the Circuit Court for the City of Charlottesville, Virginia.
Mr. Wasmuth served on the Board of Directors of the Federal Defender Program from 1993 to 1999 and was the President of the Board from 1997 to 1998.
Mr. Wasmuth also is a certified USA Swimming stroke and turn official. That allows him to keep up with his wife, Clarice, who is a certified referee, and his three children who are year-round swimmers at Dynamo Swim Club.

Representative Experience
- Successfully represented a client in an appeal that resulted in the reversal of a dismissal of a multi-million dollar antitrust claim. In re Copper Antitrust Litigation, 436 F.3d 782 (7th Cir. 2006)
- Represented a client in an appeal that resulted in the reversal of a multi-million dollar judgment in a civil rights case. Corey Airport Services, Inc. v. Clear Channel Outdoor, Inc., 682 F.3d 1293 (11th Cir. 2012).
- Successfully represented a client in an appeal that resulted in Missouri’s recognizing a reporter’s privilege limiting discovery in a libel case. State ex rel. Classic III Incorporated v. Ely, 954 S.W.2d 650 (Mo. App. 1997).
- Successfully represented client in an appeal that established in Georgia that the date on which a loss was measured under a lender’s title insurance policy was the date the mortgaged property was foreclosed on. Old Republic Nat. Title Ins. Co. v. RM Kids, LLC, 788 S.E.2d 542 (Ga. App. 2016).
- Represented a client in obtaining the reversal of a dismissal of a wrongful death claim. Stopanio v. Leon’s Fence and Guardrail, LLC 815 S.E.2d 232 (Ga. App. 2018).
