Antitrust and Trade Regulation
Smith, Gambrell & Russell, LLP has traditionally handled large antitrust cases and transactions involving antitrust issues, including:
- Serving as lead counsel in two large antitrust class action suits in Atlanta
- Arguing before the U.S. Supreme Court the principal case establishing the limits of the Federal Trade Commission’s jurisdiction
- Establishing in federal court that arbitration clauses in dealer-termination disputes can be enforced
- Litigating before the Georgia Supreme Court the rights to sue unfair competitors under the Uniform Deceptive Trade Practices Act
- Advising clients about the legality of mergers and acquisitions, including Hart-Scott-Rodino filings
- Representing franchisors (and some franchisees) in franchise disputes and representing franchisors in their compliance with federal and state regulations
- Defending clients accused of criminal price-fixing or bid-rigging and representing them in grand-jury investigations
- Litigating the antitrust issues involved in patent, trademark and copyright disputes
- Assisting clients in designing and maintaining their antitrust compliance programs to prevent antitrust problems

Two of our attorneys have been elected chairs of the Antitrust Law Section of the State Bar of Georgia. In addition, our antitrust attorneys frequently speak to national organizations and write for academic law journals on antitrust issues.
