Massachusetts State Health Insurance Law Update

If you have 11 or more employees in Massachusetts, you are now required to comply with new state health insurance laws that went into effect July 1, 2007. Among these new laws is a requirement that employers with a cafeteria plan (also known as Section 125 plans or premium only plans) add provisions to their plan allowing employees to pay for enrollment in the Massachusetts-provided health plan on a pre-tax basis, and to register the plan, in accordance with the new Massachusetts law. A failure to comply with this requirement can obligate you to reimburse the state of Massachusetts for certain medical costs of your employees.
