Employers with employees in Massachusetts who were facing an October 1 deadline to file Section 125 cafeteria plans with Massachusetts state officials have been given a permanent reprieve.
The Massachusetts Commonwealth Health Insurance Connector Authority (“Commonwealth Connector”), the public authority that implements Massachusetts’ 2006 health care reform law, changed its policy requiring employers to automatically file a copy of their Section 125 cafeteria plans. Now the employers subject to the requirement must only provide the Commonwealth Connector with a copy of a cafeteria plan upon a specific request by the Commonwealth Connector.
