Seattle’s 2012 “Paid Sick and Safe Time Ordinance”

  • Requires that paid sick and safe time be provided to all employees, including part-time and temporary employees, who work within the Seattle city limits;
  • Applies to all employers with more than four employees;
  • Tier 1 Employers (those who employ between 4 and 49 full-time equivalent employees) must provide one hour of paid sick and safe leave time for every 40 hours worked, up to a maximum of 40 hours per calendar year;
  • Tier 2 Employers (those who employ between 50 and 249 full-time equivalent employees) must provide one hour of paid sick and safe leave time for every 40 hours worked, up to a maximum of 56 hours per calendar year;
  • Tier 3 Employers (those who employ 250 or more full-time equivalent employees) must provide one hour of paid sick and safe leave time for every 30 hours worked, up to a maximum of 72 hours per calendar year;
  • Employees begin accruing leave when they are hired, and they may begin using their accrued leave 180 days after they are hired;
  • Leave may be used for the employee’s own health condition or injury, to care for the health condition or injury of a family member, or due to the domestic abuse, sexual assault, or stalking of the employee or a family member;
  • Employees must request to use their leave in writing at least 10 days in advance, unless the leave is unforeseeable, in which case the employee must give notice “as soon as practicable;”
  • Employers may require documentation when an employee uses more than three days of paid sick or safe leave consecutively
