SGR Represents Alleged Contributor In Settlement of Consolidated Superfund Action

SGR environmental attorneys Steve O’Day and Chris Bowers represented an alleged waste generator who was named as a third party defendant in two related lawsuits in Federal district court in New Jersey brought by the U.S. Environmental Protection Agency (USEPA) and the New Jersey Department of Environmental Protection (NJDEP) against dozens of private entities, government agencies and municipalities who allegedly contributed waste to the Combe Fill South landfill, located in the Chester and Washington townships, Morris County, New Jersey prior to 1981. The lawsuits, first brought in 1998, sought recovery of site closure and remediation costs, including costs for additional cleanup and monitoring of the site well into the future. Following extensive discovery and an alternative dispute resolution process, the parties, including the alleged generator client represented by SGR, engaged in extensive settlement negotiations culminating in an agreement to enter into a global settlement in the latter half of 2008. A Partial Consent Decree was filed for court approval in December 2008, and has been published for public review and comment by the USEPA and NJDEP.
