New Regulations Proposed for Georgia Clean Energy Tax Credit

Georgia’s Department of Revenue recently proposed amendments to the state code section that deals with the implementation and administration of tax credits for construction, purchase, or lease of clean energy property.

The proposed amendments bring O.C.G.A. § 48-7-29.14 into harmony with previous amendments to the statute, which amendments raised the credit cap for 2012, extended the cap through 2014 and implemented a waiting list for applicants who apply once the credit cap has been reached. The previous amendments to the statute became effective on January 1, 2011.
