Additional $5M in Brownfield Funding

Brownfields Revitalization Act

The Small Business Liability Relief and Brownfields Revitalization Act authorizes the EPA to make additional funds available in any year based on the demand for the funding.  Due to high demand, the EPA announced last Friday that it is offering an additional $5,000,000 to recipients of its Brownfield revolving loan fund agreements in fiscal year 2020.  Federal Brownfield funding contributes to the redevelopment of the underuse properties that may be contaminated by providing loans for site investigation and cleanup. EPA Proposes Rule to Remove Reference from Outdated Due Diligence Standard

On June 17, the EPA proposed a rule that would remove references to the outdated 2005 industry standard for assessing Brownfields and other sites for potential environmental issues. The proposed rule would amend the EPA’s All Appropriate Inquiry (“AAI”) rule under the Comprehensive Environmental Response, Compensation and Liability Act. (“CERCLA”). Conducting an investigation that meets the AAI standard is one of the necessary steps to achieving the Innocent Landowner Defense under CERCLA.
