Solvent Contaminated Industrial Wipes Excluded from RCRA

The U.S. EPA has finalized a rule excluding disposable solvent-contaminated wipes from regulation as a hazardous waste under the Resource Conservation and Recovery Act (“RCRA”).  The application of hazardous waste rules to solvent contaminated wipes have, historically, been inherently difficult for industry to implement, and the exemption is expected to greatly reduce the regulatory burden.  To qualify for the exclusion, businesses will have to manage the wipes in closed, labeled containers, and the wipes cannot contain free liquids when sent for cleaning or disposal.
