Mark C. de St. Aubin is a Partner in Smith, Gambrell & Russell’s Construction Law Practice.
For 25 years, Mr. de St. Aubin has advised clients on matters arising out of public and private construction projects across the country and throughout the world.
With a focus primarily on resolving construction project disputes through arbitration, mediation and the courts, Mr. de St. Aubin has also represented his clients in public contracting matters involving state and federal government agencies. The scope of issues litigated is broad, ranging from design deficiencies, delay, productivity, bid disputes, construction defects, scope change and project mismanagement.
In addition to litigating construction disputes, Mr. de St. Aubin has drafted and negotiated all types of construction agreements. Whether on behalf of owners, developers or contractors, his drafting and negotiating experience spans from standard design-bid-build to public private partnership agreements, and all variety of construction, procurement and engineering agreements that lie in between or relate to the two.
Recently, Mr. de St. Aubin was appointed to Chair the Steering Committee of the Georgia Alliance of Public Private Partnerships (GAP3), an affiliate of the Georgia Chamber of Commerce. The GAP3 promotes education in the area of P3 delivery and Georgia’s broad enabling legislation in the areas of transportation, water and social infrastructure.
Mr. de St. Aubin dedicates significant time to the Atlanta community, currently serving as a founding board member of the Cristo Rey Atlanta Jesuit High School, which began its first academic year in the Fall of 2014. He and his wife Sibyl have two children, Camille and Edward, and are parishioners at the Cathedral of Christ the King.
