E.K. Cottrell is a Partner in the Litigation Practice of Smith, Gambrell & Russell, LLP and a member of the Firm’s Securities Litigation Practice Group.
Mr. Cottrell practices in the area of complex commercial litigation. Some of his representative areas of practice include defense of class actions on behalf of insurers, business entities, and management for alleged improper market conduct or business practices, mergers and acquisitions, securities, and fiduciary obligations; representation of financial institutions concerning creditors’ rights and obligations; representation of insurers and reinsurers in coverage and regulatory compliance matters; and other general business litigation.
Mr. Cottrell has litigated class actions and other complex commercial litigation matters in the federal and state courts in numerous jurisdictions, including Alabama, Arizona, Arkansas, California, Delaware, Florida, Georgia, Illinois, Minnesota, Montana, New Mexico, New York, North Carolina, Ohio, Oklahoma, Pennsylvania, Texas, Washington, and West Virginia. He is lead class action counsel for several Fortune 100 companies, and serves as the primary class action counsel nationally on property and casualty issues for one of the nation’s largest insurance companies. In addition to defending his corporate clients, he has represented companies in bringing claims for business losses arising from breach of contract, unfair business practices and fraud, resulting in recoveries that have ranged from several hundred thousand dollars to over a hundred million dollars.
Mr. Cottrell is a member of the American Bar Association. He is active in the Class Actions & Derivative Suits Committee, serving as Chair of the Membership Subcommittee and presenting on class action trends and issues. Mr. Cottrell is also active in the Corporate Counsel Committee, serving as Co-Chair of the Insurance Coverage Subcommittee. He is also a member of the Business Litigation Section of the Florida Bar.
Mr. Cottrell received his B.S. degree, cum laude, from Wake Forest University, Calloway School of Business in 1988. In 1994, He earned his J.D., with honors, from the University of Florida College of Law, where he served as Editor-in-Chief for the Florida Journal of International Law.
He is admitted to practice in Florida; the U.S. Supreme Court; Florida State Courts; U.S. Court of Appeals, Seventh Circuit; U.S. Court of Appeals, Eleventh Circuit; U.S. District Court, Middle District of Florida; U.S. District Court, Northern District of Florida; and U.S. District Court, Southern District of Florida.
Mr. Cottrell is an active member at Community Presbyterian Church, having served as Chair of the Board of Trustees, a Session Elder, and on the Finance and Mission Committees. He is also involved in efforts supporting the public schools, including recently being appointed to the Envisioning Committee for the Duval County Public School System and serving as President of Friends of Atlantic Beach Elementary for the past eight years. Mr. Cottrell is also a member of the National Eagle Scout Association. He also serves as an Alumni-in-Admissions Representative for Wake Forest University.
