Mark C. de St. Aubin
Mark C. de St. Aubin is a Partner in the Construction Law Practice of Smith, Gambrell & Russell, LLP.
Though his practice is concentrated in the area of Construction Law, he also represents clients in complex commercial matters.
Focusing primarily on resolving both national and international private project disputes through arbitration, mediation and the courts, Mr. de St. Aubin has also represented his clients in public contracting matters involving state and federal government agencies. Whether public or private projects, the range of issues litigated is all-inclusive, ranging from design deficiencies, project delay, bid disputes, construction defects, scope change and project mismanagement.
Mr. de St. Aubin has lectured on Green Building project risks, Green Building code and ordinance trends, integrated methods of project delivery, EPC contracting for infrastructure, power and process projects, public-private project development, among a host of other construction industry-related legal issues. Currently, he serves on the Board of the Construction Management Association of America for the South Atlantic Chapter.
Mr. de St. Aubin has co-authored five articles for Construction Business Review, titled “Minimizing the Risks of Foreign Construction Contracts,” “The Risks of Litigating with Foreign Companies,” “Fighting City Hall and Making Them Pay: Recovery of Attorneys Fees Under the Equal Access to Justice Act,” “The Advantages and Disadvantages of Design-Build Contracting” and “Owners Perspective: Allocating Contract Administration Duties and Responsibilities Between Construction Managers and Architects.”
A native of Atlanta, Mr. de St. Aubin received his B.A. degree from Wake Forest University in 1989. He received his J.D. degree from the University of Mississippi in 1993, where he served as Symposium Editor of the University of Mississippi Law Journal. He is admitted to practice in Georgia and is a member of the Atlanta Bar Association.
Mr. de St. Aubin is active in the Atlanta community, having been selected as a member of the Buckhead Business Association’s Leadership Development Program and Outstanding Atlanta. He also dedicates significant time to the Catholic Church in Atlanta, serving on the the Atlanta Archdiocese’s Facilities Advisory Board and volunteering his time at the St. Ignatius Jesuit Retreat Facility in Sandy Springs.
He and his wife Sibyl have two children, Camille and Edward, and are parishioners at the Cathedral of Christ the King.
