Joyce B. Klemmer

Joyce B. Klemmer, a partner in the Intellectual Property Section, has specialized in Intellectual Property litigation in the federal courts for over 20 years.

She has successfully prosecuted and defended hundreds of copyright patent, trade secret and trademark cases for European and domestic clients. She has taken and defended depositions in Germany, France, the Netherlands and Brazil through interpreters. She has argued and prevailed in cases she won in the trial courts that were later appealed to the Federal Circuit Court of Appeals and the Eleventh Circuit Court of Appeals. She has represented the American Society of Composers, Authors and Publishers (ASCAP) in all copyright infringement cases brought in Georgia for the past 19 years.

She has litigated Intellectual Property disputes involving infringement on the Internet including domain name cybersquatting, trademark infringement and copyright infringement. In addition to litigating, Joyce regularly counsels clients regarding the clearance, protection and licensing of copyrights, trademarks, trade secrets and other intellectual property rights and assists clients with obtaining, maintaining and enforcing copyright and trademark rights and registrations. She works with many US and European companies on a broad range of IP topics including contracts, internet related issues including the DMCA, advertising, content liability and avoiding intellectual property infringement.

Joyce received her B.S. degree from Rochester Institute of Technology, with High Honors, in 1978. She earned her J.D. from the Emory University School of Law in 1981, where she was a member of the Emory Law Review.

She regularly authors articles and lectures on IP Litigation topics. She is a past Chairman of the Intellectual Property Section of the State Bar of Georgia. She headed the committee that drafted the Georgia Trade Secrets Act. She is one of the firm’s two named representatives to the International Trademark Association.
