David C. Newman

David C. Newman is a Partner and Head of the Atlanta Litigation Practice of Smith, Gambrell & Russell, LLP.

Mr. Newman has particular expertise in complex business litigation, including securities and antitrust litigation, director and officer liability and shareholder derivative litigation. He has extensive jury trial and arbitration experience.

Mr. Newman has represented directors and officers for more than 25 years in the context of shareholder derivative and securities claims. He has also represented special investigative board committees, as well as directors and officers investigated by such committees. A small sampling of those cases includes:

• The successful representation of the CFO and other officers of a publicly traded company in a large securities case involving allegations of accounting and other fraud. The case was litigated in the Northern District of Alabama.
• The successful representation of officers and directors in securities claims involving fraud allegations in connection with publicly traded companies in the Northern District of Georgia.
• The successful representation of former officers and other employees against claims of breach of fiduciary duty and other claims in connection with their start-up company. The case was litigated in the Northern District of Georgia.

Mr. Newman is also involved in securities class actions and other shareholder-related litigation such as derivative claims and dissenter's rights actions. He also has substantial experience in other areas of complex business litigation such as antitrust and contract disputes.

Most recently, Mr. Newman successfully defended a German manufacturer against a $30 million claim in an extended arbitration in the International Court of Arbitration. He also served as co-lead counsel in the successful prosecution of a large antitrust case involving market manipulation.

A native of New York, Mr. Newman received his B.S., cum laude, in economics and political science from The American University in 1979. He earned his J.D., with honors, in 1982 from the University of Tennessee, serving as the Research Editor of the Tennessee Law Review and a member of the Jessup International Law Moot Court Team. Mr. Newman is admitted to practice in Georgia and has practiced extensively in courts across the nation.

He is active in the Atlanta community, having served on the Board of Directors of several non-profit and youth organizations.
