Alexander S. Clay

Alex Clay is Counsel in the Atlanta office of Smith, Gambrell & Russell, LLP.

He is a member of the Real Estate Section. Mr. Clay has extensive experience representing both local and national lending institutions as well as developers in connection with a wide variety of commercial real estate transactions. Ranging from simple purchase and sale transactions to complex tax-free exchanges with multi-tiered financing, the projects he has been involved in include the acquisition, development and permanent financing of office buildings, shopping centers, hotels, industrial developments, warehouse facilities, business parks, condominiums, mixed use projects and residential communities. His commercial lending practice also includes assisting lenders with the negotiation, structuring and implementation of special asset dispositions involving commercial real estate loans, bringing in the expertise of attorneys from the firm’s Commercial, Bankruptcy and Litigation sections as and when necessary.

Mr. Clay’s practice also includes the representation of buyers and sellers in large timberland transactions regionally and nationwide.

Representative Transactions

• Acquisition of 900,000 acres of timberland located in Texas, Louisiana and Arkansas, representing the purchaser.
• $150 million term loan secured by 20 commercial distribution centers located in 10 different states across the country, representing the borrower.
• $80 million construction loan for the development of an apartment complex in Miami, Florida on property controlled by the University of Miami and part of a municipal redevelopment district, representing the lender.
• Three simultaneous construction loans totaling $60 million for the development of condominiums and mixed-use properties in Florida, North Carolina and South Carolina, representing the lender.
• $32 million construction loan for the development of an apartment complex in Dallas, Texas, representing the lender.
• $30 million acquisition loan for the purchase of an office tower in Chicago, Illinois, representing the lender.
• $6 million construction loan for a commercial building located in the City of Atlanta within an Atlanta Tax Allocation District, representing the lender.
• $10 million construction loan for a condominium located in Gainesville, Georgia, representing the lender.

Mr. Clay attended Guilford College in Greensboro, North Carolina, where he received a B.A. in History in 1993. He received his J.D. degree from the University of Georgia in 1996.

Mr. Clay is a member of the State Bar of Georgia and the Atlanta Bar Association.
