David C. Newman

David C. Newman is a partner in the Litigation Section of Smith, Gambrell & Russell, LLP and serves as a member of its Executive Committee.

Mr. Newman has particular expertise in complex business litigation, including securities and antitrust litigation, director and officer liability and shareholder derivative litigation.

Mr. Newman is principally involved in securities class actions and other shareholder-related litigation such as derivative claims and dissenter’s rights actions. He also has substantial experience in other areas of complex business litigation such as antitrust, contract disputes and officer and director liability. Mr. Newman has also participated in a number of internal corporate investigations and related litigation representing Special Board Committees. His experience includes numerous jury trials, bench trials and large complex arbitrations.

Most recently, Mr. Newman successfully defended a German manufacturer against a $30 million claim in an extended arbitration in the International Court of Arbitration. Mr. Newman also served as co-lead counsel in the successful prosecution of a large antitrust case involving market manipulation.

A native of New York, Mr. Newman received his B.S., cum laude, in economics and political science from The American University in 1979. He earned his J.D., with honors, in 1982 from the University of Tennessee, serving as the Research Editor of the Tennessee Law Review and a member of the Jessup International Law Moot Court Team.

Mr. Newman is admitted to practice in Georgia, and has practiced extensively in courts across the nation. He is active in the Atlanta community, having served on the Board of Directors of several non-profit and youth organizations.
