SGR Environmental Attorneys Achieve Favorable Settlement in Toxic Mold Litigation

SGR attorneys represented one of three defendants in a ground-breaking toxic mold claim in Michigan. In what was one of the first ever toxic mold cases in Michigan, the plaintiff claimed personal injuries—specifically, mold-induced asthma—from exposure to alleged toxic mold on pressure-treated wood. The defendants included the seller and distributor of the wood, and SGR’s client, the manufacturer of the wood treatment chemical. The plaintiff sought unspecified damages, with the initial settlement demand exceeding $300,000. Aggressive pursuit of the plaintiff’s past medical history, and retention of pulmonary and mold experts to rebut the plaintiff’s claims, resulted in a settlement of just $66,000, with only $22,000 being paid by SGR’s client. The SGR team was led by partners Stephen O’Day and Andy Thompson.
