Southwire Obtains Reversal of Dismissal in Copper Antitrust Litigation

Smith, Gambrell & Russell represented Southwire Company in obtaining the reversal of the dismissal of Southwire’s multi-million dollar antitrust claim against J.P. Morgan & Company. The trial court had dismissed the claim on statute of limitations grounds. The United States Court of Appeals for the Seventh Circuit ruled that sufficient evidence existed to support Southwire’s claim that its lawsuit was timely. The decision is reported at In re Copper Antitrust Litigation, 436 F.3d 782 (7th Cir. 2006). The SGR team representing Southwire in the appeal included Edward H. Wasmuth, Jr., who presented oral argument in the Court of Appeals, James H. Bratton, Jr. and William W. Maycock.
